1. Acceptance of Terms
By accessing or using Anmeson's website, services, or products, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
2. Services
Anmeson provides digital and business services including, but not limited to: web application development, mobile app development, desktop application development, graphic design, CI/CD & DevOps, IT solutions & remote support, business automation, WordPress development, accounting & finance consulting, and bookkeeping.
The scope of services for each engagement will be defined in a separate Statement of Work (SOW) or project agreement signed by both parties.
3. Client Responsibilities
Clients are responsible for:
- Providing accurate, complete, and timely information required to deliver the services
- Reviewing and approving deliverables within agreed timeframes
- Ensuring all third-party accounts, licenses, and access credentials required for the project are available
- Nominating a primary point of contact for project communication
Delays caused by the client's failure to fulfill these responsibilities may result in project timeline adjustments and/or additional charges.
4. Intellectual Property
Upon full payment of all invoices, Anmeson transfers ownership of all custom deliverables (code, designs, content) to the client, unless otherwise agreed in writing.
Anmeson retains the right to:
- Use open-source libraries and third-party tools as part of deliverables (subject to their respective licenses)
- Display completed work in its portfolio, case studies, and marketing materials unless the client requests confidentiality in writing
Pre-existing tools, frameworks, templates, and methodologies developed by Anmeson remain the intellectual property of Anmeson.
5. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement and not disclose it to third parties without prior written consent. This obligation survives termination of the agreement.
6. Payment Terms
- Invoices are issued as specified in the project agreement (typically milestone-based or monthly).
- Payment is due within 7 days of invoice date unless otherwise agreed.
- Late payments may incur a fee of 2% per month on outstanding balances.
- Anmeson reserves the right to pause or suspend work on accounts with overdue invoices until payment is received.
7. Refund Policy
Anmeson is committed to delivering high-quality work. However, due to the custom and time-intensive nature of our services, the following refund policy applies:
7.1 Deposits & Upfront Payments
All deposits and upfront payments are non-refundable once work has commenced. These payments compensate for resource allocation, discovery, and initial planning work already completed.
7.2 Milestone-Based Refunds
- If a project is cancelled before a milestone begins, any advance payment for that milestone will be refunded in full.
- If a project is cancelled after a milestone has commenced, you will be charged for the work completed up to that point. Any balance remaining after deducting completed work will be refunded within 14 business days.
7.3 Disputes & Dissatisfaction
If you are dissatisfied with a deliverable, you must notify us in writing within 5 business days of delivery. We will work with you in good faith to revise the deliverable per the agreed scope. Refunds are not issued for completed work that meets the agreed scope but does not align with subjective preferences not documented in the original brief.
7.4 Recurring Services (Retainers, Support Plans)
Monthly retainer or support plan payments are non-refundable for the current billing period. You may cancel at any time with 30 days' written notice, effective from the next billing cycle.
7.5 Digital Products & Templates
Any digital products, templates, or pre-built solutions sold by Anmeson are non-refundable once downloaded or accessed.
7.6 Refund Process
Approved refunds will be processed via the original payment method within 14 business days of approval. Anmeson reserves the right to request supporting documentation before processing any refund.
8. Project Changes & Scope Creep
Any changes to the agreed scope of work must be submitted in writing. Additional features, redesigns, or requirements outside the original brief may require a new quote and timeline adjustment. Anmeson is not obligated to absorb scope changes at no additional cost.
9. Warranties & Disclaimers
Anmeson warrants that:
- Services will be performed with reasonable skill and care
- Deliverables will substantially conform to the agreed specifications
Anmeson does not warrant:
- Uninterrupted or error-free operation of any software after handover
- Specific business outcomes (traffic, revenue, conversions) resulting from our services
- Third-party services, APIs, or tools integrated at client request
10. Limitation of Liability
To the maximum extent permitted by law, Anmeson's total liability to the client for any claim arising out of or related to the services shall not exceed the total fees paid by the client in the 3 months preceding the claim. Anmeson is not liable for any indirect, incidental, consequential, or special damages.
11. Termination
Either party may terminate an engagement with 14 days' written notice. Upon termination:
- The client will be invoiced for all work completed to date
- Anmeson will deliver all completed work and project assets to the client within 7 business days
- Refunds, if applicable, will be processed per Section 7
12. Governing Law
These Terms are governed by applicable laws of the jurisdiction in which Anmeson operates. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the applicable courts of jurisdiction.
13. Changes to Terms
Anmeson reserves the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.
